Hi Folks , just wondering the above as i had a 15 year old cyclist run into my van the other week while i was parked and it looks like i'll be going the small claims route after being led up the garden path on payment for the last 2 weeks Anyone have any experience of this kind of claim/outcome ?

As I understand it the law is complicated regarding children and young persons, I dont know if you can make a CC claim against a fifteen year old and not sure whether the parents could be liable. I would have a word with your insurance company first, they normaly have a lawyer that deals with stuff like that.

It certainly is Joe .... after the accident i was given the address and home phone number of the lad however no one answers the phone. I then get a neutral estimate from a bodyshop ( not mine ) and knock on the door with it. Instead of the 220 pounds quoted by the bodyshop i offered to accept 100 pounds as i have my own body repair company and would try to be fair, she agreed and i was to wait 3 weeks to collect the money. To save myself about 5 paragraphs of typing all i will say is 1 parent family that know how to flout the law....with the stereotypical s.o.b child who can do no wrong. Police don't want to know and were about as much use as a chocolate teapot ......as they were 3 weeks ago when some one hit and run the van nearly driving me off the road at 50mph I've got protected no claims but have had 1 claim 4 years ago for vandal damage to a previous car so this will bring me up to the max before i start losing ncb should anything else happen. Besides my insurance would go up next year as i've been involved in an accident while stationary and am a 'statistically' higher risk. I'll probably end up walking away from it , tho it does make me bloody mad when you try to be fair and scum like this abuse the law. It really grips my #### that the law is so useless in cases like this and many others and that we have a government that's more interested in introducing laws regarding the price of pasties, hiding cigarettes behind doors in supermarkets and giving away the pension fund to those who've paid bugger all into it etc etc Excuse me while i turn into my dad for a moment ;D

And after a call to my insurer i can confirm there's nothing i can do unless i want to pay the price for making a claim later on ....as they dont like being paid 10p a month for eternity either
